Joy is Sad
The verdict is out. 2-1 against Lina Joy or Azlina Jailani.
Chief Justice Tun Ahmad Fairuz Sheikh Abdul Halim and Justice Dato’ Alaudin Mohamed Sheriff read their their judgement almost in the similar tone that according to Article 121 (1A) of the Federal Constitution, Civil Court does not have any jurisdiction to any matter which falls under the power of Syariah Court. Lina Joy needs to prove that Syariah Court has declared her a non-Muslim before she can drop out ‘Islam’ from her Identity Card.
On the other hand, Justice Richard Malanjum, who the only one granted Joy’s appeal, has argued in the basis of the Federal Constitution is the supreme law of the land, which states under the Article 11, every citizen has freedom to religion.
Both arguments seem the same to me, “the Federal Constitution is the supreme law of the land”, no matter what. Either Article 11 or 121(1A) is under the Consti. Every party made his judgement according to the Consti.
However, if the Government is really trying to be the savior of Islam by not letting Muslims apostate, there are better ways.
Muslims in this country have digressed (notice the word digress) alittle bit from the way of Islam. Look every where and you’ll agree with me. Not many still practice Islam as it is. Islam is not only about praying, fasting, contribute to zakat and do pilgrimage to Mekah. Islam is the way of life. From the moment you’re born and till the last eye that lay upon you when people bury you up under the tomb, is Islam. Every single thing that you do is Islam. Islam is not only about saying ‘bismillah’ before you eat but also how you eat, whether the food will benefit you and how you use your energy from the food to benefit others. Islam is about everything that benefit people around you, floral, fauna and yourself. It’s like a symbiosis. And that is why when a Muslim greet people they say ‘peace upon you’. Because Islam is Peace.
What should the Government do? The Government should implant this idea of Islam in every Muslim’s mind. Understanding the true Islam is essential. Nowadays, Malaysians only see Islam in ibadah. This perception needs to be changed. If not, more Lina Joys will come out and knock on the doors of Palace of Justice. More WTC will collapse, and conflict between Palestine and Israel will continue to the next millenniums.
